By accessing or using the website at losbanosfence.com (the "Site"), or by requesting services from Quality Los Banos Fence, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site or request services.
Quality Los Banos Fence provides residential and commercial fence installation, repair, and related services in Los Banos, California, and surrounding areas. The specific scope of work for any project is defined in the written proposal or contract provided to the customer prior to the start of work. Services are subject to availability and geographic coverage at the time of the request.
All estimates provided by Quality Los Banos Fence are based on the information available at the time of the site visit. Written estimates are valid for 30 days from the date of issuance unless otherwise noted. Verbal estimates are not binding.
The final price may differ from the original estimate if: (a) the scope of work changes at the customer's request after the estimate is accepted; (b) unforeseen conditions are discovered during the project that were not apparent at the time of the estimate, such as buried obstructions, unstable soil, or concealed damage; or (c) material costs increase substantially between the date of the estimate and the scheduled installation date.
If any change is expected to affect the final price, Quality Los Banos Fence will notify the customer before proceeding with additional work.
Installation dates are scheduled based on crew availability and are confirmed in writing or by phone. We reserve the right to reschedule a project due to weather conditions, crew illness, or other circumstances outside our control. We will provide reasonable notice of any rescheduling.
Customers who need to cancel or reschedule a confirmed installation appointment must do so at least 48 hours in advance. Cancellations made with less than 48 hours notice may result in a scheduling fee, as detailed in your written contract.
Projects that have already begun may not be cancelled without compensation to Quality Los Banos Fence for work completed and materials ordered or delivered.
Payment terms are specified in the written proposal or contract provided for each project. Unless otherwise agreed in writing, a deposit may be required prior to scheduling installation, with the balance due upon completion of the work.
Accepted payment methods will be confirmed at the time of estimate. Invoices not paid by the due date specified in the contract may accrue a late fee as stated in that contract.
All materials remain the property of Quality Los Banos Fence until payment is received in full.
By scheduling a project with Quality Los Banos Fence, the customer represents and warrants that:
Quality Los Banos Fence is not liable for delays or additional costs resulting from the customer's failure to meet these responsibilities.
Where required by local ordinance, Quality Los Banos Fence will apply for building permits on the customer's behalf as part of the project scope. Permit fees are the responsibility of the customer and will be itemized in the written estimate. The customer is responsible for obtaining any required HOA approvals. Work will not begin until all required permits and approvals are in place.
Quality Los Banos Fence stands behind the quality of its work. Details of any workmanship warranty applicable to your specific project will be provided in your written contract. Warranty coverage is limited to defects in installation and does not cover damage caused by: acts of nature, vandalism, vehicle impact, soil movement beyond normal seasonal variation, improper use or modification by the customer, or failure to perform recommended maintenance.
Material warranties, if any, are subject to the terms of the manufacturer of the materials used. Quality Los Banos Fence will assist in facilitating manufacturer warranty claims where applicable.
To the maximum extent permitted by applicable law, Quality Los Banos Fence shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of the Site or from the performance or non-performance of services. Our total liability for any claim arising out of or relating to a service project shall not exceed the amount paid by the customer for that specific project.
Nothing in these Terms limits our liability for gross negligence, fraud, or any liability that cannot be excluded by law.
The content on this Site is provided for general informational purposes only. While we make reasonable efforts to keep information accurate and up to date, we make no warranties, express or implied, regarding the completeness, accuracy, or reliability of any content on the Site. If a dispute arises out of or relates to these Terms or any services provided by Quality Los Banos Fence, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, the parties agree to submit to binding arbitration in Los Banos, California, under the rules of the American Arbitration Association, before pursuing any other legal remedy.
Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Merced County, California.
Quality Los Banos Fence reserves the right to update these Terms and Conditions at any time. Changes will be posted on the Site with a revised effective date. Continued use of the Site or continued engagement of our services after changes are posted constitutes acceptance of the updated Terms.
